ClearHaul LLC is a technology company, not a law firm. Nothing on this website, in the ClearHaul platform, in any compliance certificate, or in any communication from ClearHaul constitutes legal advice. ClearHaul does not represent or advise any customer on legal matters, regulatory compliance strategy, or litigation.

Freight broker liability under federal transportation law — including interpretations arising from court decisions such as Montgomery v. Caribe Transport II and related cases — is a complex and evolving area of law. You should consult a qualified transportation attorney for legal advice specific to your situation.

2. Screening results are not guarantees

ClearHaul performs compliance screenings by querying publicly available and third-party data sources including FMCSA SAFER, OFAC SDN lists, BIS entity lists, state DMV records, and FMCSA PSP records. These sources may contain incomplete, outdated, or inaccurate information. A passing result from ClearHaul:

• Does not guarantee that a carrier or driver is safe, competent, or suitable for any particular load
• Does not guarantee that a carrier or driver is in full compliance with all applicable federal, state, or local regulations
• Does not guarantee that a carrier will perform the contracted services without incident
• Does not eliminate or reduce any legal duty of care that a freight broker may owe under applicable law
• Does not constitute a finding that a broker has met the applicable standard of care in any particular case

3. Compliance certificates are documentation tools

ClearHaul compliance certificates are cryptographically sealed records documenting that specified screening checks were performed at a specific date and time, and what the results of those checks were at that moment. These certificates are designed to assist brokers in documenting their compliance screening activities.

A ClearHaul compliance certificate:

• Is evidence of what screening was performed and when — not evidence of carrier or driver fitness
• Reflects data available at the time of the screening — carrier or driver status may change after a certificate is issued
• Does not constitute a legal opinion on whether a broker has satisfied any applicable standard of care
• Has not been reviewed, endorsed, or certified by any government agency, court, or legal authority

4. Third-party data sources

ClearHaul relies on data provided by third-party sources including the FMCSA, U.S. Department of the Treasury (OFAC), U.S. Department of Commerce (BIS), and state Departments of Motor Vehicles. ClearHaul does not control these sources and is not responsible for errors, omissions, delays, or inaccuracies in the data they provide. Real-time data queries reflect information available at the moment of the query and may not reflect the most current status of a carrier or driver.

5. Not a substitute for independent judgment

ClearHaul screening results are one input into the carrier selection process — not a replacement for broker judgment, industry knowledge, or other due diligence practices. Brokers retain full responsibility for their carrier selection decisions and should not rely solely on ClearHaul results when making those decisions.

6. No warranty

THE CLEARHAUL PLATFORM AND ALL SCREENING RESULTS, COMPLIANCE CERTIFICATES, AND RELATED OUTPUTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
